1. Acceptance of Terms
By accessing or using the Tailwind Loops application and website (the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Tailwind Loops is a route planning service for human-powered activities including road cycling, gravel cycling, running, and walking. The Service uses AI-assisted route generation, OpenStreetMap data, and corridor-based scoring to suggest routes tailored to your preferences.
3. User Accounts
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate and complete information and to update it as necessary.
4. Subscriptions and Payments
Some features of the Service require a paid subscription. Subscriptions are billed through Stripe on a recurring basis. You may cancel your subscription at any time through the Account settings page. Cancellation takes effect at the end of the current billing period.
We reserve the right to change subscription pricing with reasonable notice. Price changes will apply to subsequent billing periods, not to the current one.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract source code from the Service
- Interfere with or disrupt the Service or its infrastructure
- Scrape, crawl, or use automated tools to access the Service in bulk
- Share your account credentials with others
- Impersonate another person or entity
6. Route Safety and Assumption of Risk
IMPORTANT: Routes generated by the Service are informational suggestions only. Tailwind Loops does not guarantee the safety, legality, accuracy, or suitability of any route for any purpose, activity type, or fitness level.
Route data is derived from OpenStreetMap and other third-party sources that may be incomplete, outdated, or inaccurate. Road and trail conditions, traffic patterns, weather, construction, closures, and other hazards can change at any time without notice and may not be reflected in the Service.
By using the Service, you acknowledge and agree that you assume all risk associated with following any route suggested by the Service. You are solely responsible for your own safety and the safety of others while engaged in any activity. You agree to exercise your own independent judgment, obey all applicable traffic laws and regulations, and assess real-world conditions before and during any activity.
Tailwind Loops is not responsible for any personal injury, death, property damage, or any other loss or harm that may occur while following or attempting to follow any route generated by the Service. The Service does not replace the need for proper preparation, equipment, fitness, situational awareness, and personal responsibility.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by Tailwind Loops and are protected by copyright, trademark, and other intellectual property laws. Route data derived from OpenStreetMap is subject to the Open Data Commons Open Database License.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Tailwind Loops and its owners, officers, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, death, property damage, loss of data, or loss of profits, arising out of or related to your use of the Service or any route generated by the Service, regardless of the theory of liability.
In no event shall our total liability exceed the amount you paid for the Service in the twelve months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Tailwind Loops and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or any activity undertaken in connection with routes generated by the Service.
10. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that route information is accurate, complete, current, or error-free.
11. Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time through the Account settings page.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
